Judge Cashman Refuses to Step Down

On Monday, Oct. 28, Judge Cashman refused to step down from the Mulholland/Albert trial. This despite the fact that after he declared a mis-trial, he arranged a meeting between the defense attorneys and the jurors, without telling the prosecutor. According to one of the jurors from Chester County, "It seemed too congenial. Clearly, the judge and the defense attorneys were in bed together".

In addition, the judge:

• Declared a mis-trial in the Mulholland/Albert trial even though, according to many attorneys, it wasn't necessary to do so. The jury had already been informed that the police officers were going to testify, so when Cyril Wecht said "Why don't you ask Mulholland what he was doing there", the judge could have instructed the jury to disregard it.

• Tried to put a gag order on Mrs. Gammage, even though she wasn't part of the trial! He later realized that he was wrong and rescinded the order.

• Tried to ban the press from the jury selection process in Chester County. The press had to petition the state supreme court twice to get him to allow them to cover it.
