GEMS 1-18-10 Not Counted

A race is marked as Not Counted in the Race Editor and is downloaded to both AccuVote-OS and Ballot Station.  In both cases, votes cast in the race are reflected in the voting device as well as GEMS reports.  Is this intended behavior?
