II.5.b.

Engineers shall not offer, give, solicit or receive, either directly or indirectly, any political contribution in an amount intended to influence the award of a contract by public authority, or which may be reasonably construed by the public of having the effect or intent to influence the award of a contract. They shall not offer any gift, or other valuable consideration in order to secure work. They shall not pay a commission, percentage or brokerage fee in order to secure work except to a bona fide employee or bona fide established commercial or marketing agencies retained by them.

Code is relevant when:
Engineer offers a political contribution
Code is violated when:
The amount of the political contribution is intended to influence the award of a contract by a public authority
OR
The amount of the political contribution may be construed by the public of having the effect or intent to influence the award of a contract by a public authority
Code is not violated when:
The amount of the political contribution is not intended to influence the award of a contract by a public authority
AND
The amount of the political contribution cannot be construed by the public of having the effect or intent to influence the award of a contract by a public authority

Code is relevant when:
Engineer gives a political contribution
Code is violated when:
The amount of the political contribution is intended to influence the award of a contract by a public authority
OR
The amount of the political contribution may be construed by the public of having the effect or intent to influence the award of a contract by a public authority
Code is not violated when:
The amount of the political contribution is not intended to influence the award of a contract by a public authority
AND
The amount of the political contribution cannot be construed by the public of having the effect or intent to influence the award of a contract by a public authority

Engineer solicits a political contribution
Code is violated when:
The amount of the political contribution is intended to influence the award of a contract by a public authority
OR
The amount of the political contribution may be construed by the public of having the effect or intent to influence the award of a contract by a public authority
Code is not violated when:
The amount of the political contribution is not intended to influence the award of a contract by a public authority
AND
The amount of the political contribution cannot be construed by the public of having the effect or intent to influence the award of a contract by a public authority

Code is relevant when:
Engineer receives a political contribution
Code is violated when:
The amount of the political contribution is intended to influence the award of a contract by a public authority
OR
The amount of the political contribution may be construed by the public of having the effect or intent to influence the award of a contract by a public authority
Code is not violated when:
The amount of the political contribution is not intended to influence the award of a contract by a public authority
AND
The amount of the political contribution cannot be construed by the public of having the effect or intent to influence the award of a contract by a public authority

Code is relevant when:
Engineer offers a gift or other valuable consideration
Code is violated when:
The gift or other valuable consideration is intended to secure work.
Code is not violated when:
The gift or other valuable consideration is not intended to secure work.

Engineer pays a commission, percentage or brokerage fee to secure work
Code is violated when:
The commission, percentage or brokerage fee is not paid to a bona fide employee or to a bona fide commercial or marketing agency
Code is not violated when:
The commission, percentage or brokerage fee is paid to a bona fide employee or to a bona fide commercial or marketing agency
